What if You Can’t Pay Your Mortgage in Spain

If you are like many people today, you may be having trouble making ends meet or are living paycheck to paycheck. If you find yourself unable to pay your mortgage on your primary or second home, you may face major consequences. These consequences vary by country and can even vary by state or province within the same country, so it is important to understand them fully.
There are specific repercussions involved in defaulting on a Spanish mortgage. In the past, such defaulting used to be very simple. This used to be true, especially for second residences or vacation homes. However, this is no longer the case, as Spanish banks can and will pursue non-residents to fulfill their mortgage obligations.
In case a homeowner must default on a mortgage in Spain, turning over the home to the bank is often an option. Turning the home over to the bank will save you a lot of money, as the bank will not have court costs associated with pursuing you for the mortgage, and your interest will stop accruing sooner. But although this is an option, it must first be discussed with the bank. The bank can to agree to accept the home back, but they do not have to. The bank is more likely to accept the home back from you if you have had a true hardship that has affected your ability to make payments on your Spanish mortgage. An example of such a hardship would be the death of a spouse or another situation that has caused your income to be drastically cut.
If despite your attempts to negotiate a home turnover, the bank refuses your offer, you must then sell your home. You should try to get as much from the home sale as you can, as you will still be responsible to the bank for any shortfall between the home sale amount and the remaining amount on your Spanish mortgage. The bank will be most likely to aggressively pursue you for a large shortfall on the Spanish mortgage. But the bank can legally attempt to collect any amount from you. The bank may collect money by placing liens on any and all assets of the homeowner. Although it may take years to collect on the shortfall by going through the court systems, the bank that holds your Spanish mortgage will not give up until they do.
Defaulting on a Spanish mortgage is an extremely serious situation, so it is essential that the homeowner work as closely as possible with the bank as soon as it is evident that defaulting is going to be unavoidable. Showing a willingness to work with the bank can allow a homeowner to walk away from a Spanish mortgage with as little financial cost as possible and still retain full ownership of all his or her other assets.

When snow melts and trickles down the roof it can often refreeze as it reaches the edge of the roof and into gutter. You’ve probably stood back and look with astonishment at these ice dams that form, but these can unknowingly cause havoc on the integrity of your roof. However, they are relatively easy to prevent and doing so will without a doubt save you money and agony in the future.
How ice dams form.
The heat from your house melts the snow on the top of your roof because this is the warmest spot of your roof. As the melted snow flows down the roof below the snow it then reaches the roofs edge, which is next to sub zero temperature; this dive in temperature causes the water or snowmelt to refreeze generating the dams that you often see hanging off of people’s homes in winter. The weight of these dams can cause a dilemma itself, however, the real problem occurs when additional melting snow collects in pools beside the dams. In some cases you can use a rubber covering that is attached directly to the roof and the shingles are then added on top. The ultimate stage is the decond stage only as it will decide the future of the contract. It is also known as Escritura de compraventa stage. The purchaser will be required to pay the balance of the purchase price and all fees on the date of completion. The vendor and the purchaser will then come together to sign the contract, which is equivalent to a deed on the property. Also known in Spain as the escritura, the purchaser will received this deed which is usually in front of a Notary Public. A photocopy of the deed will be provided to the tax official and property registrat to ensure everything is legitimate. In Spain, Notary Publics are public officials required to witness a deed of sale, but you should also make sure to have your own independent expert legal advice to make sure that your own interests are protected during this legal process. Also keep in mind that as the purchaser you will be required to pay property sales taxes as well as the legal fees for the Notary Public.

As downward pressure is exerted on real estate commissions, the so-called smart real estate agents are spending enormous amounts of time reading about and learning techniques that will convince sellers and buyers that they are worth the inflated traditional fees. They are in effect saying, “the market be damned, I know what I’m worth, here’s why, so pay me.”
Well, the market does determine prices. The market determines what a service is worth. I accept this truism. The downward price pressure in the real estate industry is not going away. Period.
Walmart taught the world that to deliver goods and services at lower prices you had better become more efficient. They demonstrated repeatedly that to reduce costs you must improve your systems. Streamline. Work smarter. In addition to systems advances, to save money you have to improve your time management because time is money…big money.
I’ll give you some examples from my own real estate practice. We don’t spend time trying to figure out what to say to our prospective clients to get them to agree to pay us more money than someone else will charge them. We spend time developing ways to cut our costs.
Technology is one answer. It changes and improves daily. We make improvements constantly in how much more cost efficiently we can deliver our message to the seller/buyer market. And we still maintain the exceptional quality of our service and our professionalism.
Our goal has been to save time as well. Our time is very valuable, but so is yours. If we can reduce our mutual investments in the time it takes to sell or buy a home, we are both winners. It allows us to discount our services without compromising on quality and you save by receiving the same level of expertise, service, and professionalism for less money.
How is this accomplished? Actually, quite easily. Here are two methods that have given us a one-up on the competition.
You’ve heard the expression that God gave you two ears and one mouth so you could listen twice as much as you talk. We have refined our listening skills. We listen, but, more importantly, we process what you say correctly. Then, when we talk, we ask pertinent questions designed to glean information that is crucial to the real estate transaction.
